Waiver | Release of Liability

In consideration of Single Fin Surf Charters known in Costa Rica as Adarga De Plata Sociedad Anonima, Single Fin Surf Charters, furnishing services and/or equipment to enable me to participate in sailing, fishing, jet skiing, fly-boarding, standup paddle boarding (SUP), and surfing I agree as follows:

I fully understand and acknowledge that: (a) outdoor and aquatic recreational activities have inherent risks, dangers and hazards and such exists in my use of sailing, fishing, jet-skiing, fly-boarding, standup paddle boarding (SUP), and surfing equipment and my participation in the above mentioned, and other outdoor and aquatic activities; (b) my participation in such activities and/or use of such equipment may result in injury or illness including, but not limited to bodily injury, disease, strains, fracture, partial and/or total paralysis, death or other ailments that could cause serious disability; (c) Further, risks and dangers may be caused by, increased, or a direct result of the unpredictability of natural forces and weather conditions which are inherent to recreational activities that take place in a wilderness aquatic or outdoor environment. While the captain and agents of company will always exercise their best judgment in decision-making their actions and decisions may result in risks, hazards, and dangers to the participants and patrons. I understand this possibility of risk and danger, and release and hold harmless the captain, employees, and agents of Single Fin Surf Charters. i assume personally all liability for any injuries or damages occurring as a result of all for seeable and unforeseeable risks and dangers including any negligence of other patrons, breaches of contract, forces of nature and other causes; and (d) by my participation in these activities and/or use of equipment, I hereby assume all risks and dangers and all responsibility for any losses and/or damages, whether caused in whole or in part by the negligence or other conduct of the owners, agents, officers, or employees of Single Fin Surf Charters, known in Costa Rica as Adarga De Plata Sociedad Anonima, Guanacaste Province, Costa Rica, or by any other person. (e) In addition, I hereby grant permission to Single Fine Surf Charters, known in Costa Rica as Adarga De Plata Sociedad Anonima, Guanacaste Province, to make and use for promotion or other purposes, photographic records of myself without recourse or compensation to me.

I, on behalf of myself, my personal representatives and my heirs or as parent or legal guardian of the undersigned participant hereby voluntarily agree to release, waive, discharge, hold harmless, defend and indemnify Single Fin Surf Charters known in Costa Rica as Adarga De Plata Sociedad Anonima, Guanacaste Province, Costa Rica and their owners, agents, officers, employees, representatives and lenders from any and all claims, actions or losses for bodily injury, property damage, wrongful death, loss of services or otherwise, which arise out of my use of company equipment such as but no limited to: sailing, fishing, jet skiing, fly-boarding, standup paddle boarding (SUP), and surfing equipment or my participation in those activities. I specifically understand that I am releasing, discharging and waiving any claims or actions that I may have presently or in the future for the negligent acts or other conduct by the owners, agents, officers, employees or representatives of Single Fin Surf Charters, known in Costa Rica as Adarga De Plata Sociedad Anonima, Guanacaste Province, and Costa Rica.

I HAVE READ AND UNDERSTAND THE ABOVE WAIVER AND RELEASE OF LIABILITY. FURTHER, IT IS MY INTENTION TO AGREE AND EXEMPT, RELIEVE AND HOLD HARMLESS SINGLE FIN SURF CHARTERS, KNOWN IN COSTAR RICA AS ADARGA DE PLATA SOCIEDAD ANONIMA, PLAYAS DEL COCO, GUANACASTE PROVINCE, AND COSTAR RICA FROM ALL LIABILITY ARISING FROM MY PARTICIPATION IN THE AFOREMENTIONED OUTDOOR RECREATIONAL AND AQUATIC ACTIVITIES ALSO INCLUDING BUT NOT LIMITED TO ALL LIABILITY ARISING FROM EXTENDED STAYS AND OVERNIGHT HABITATION UPON ANY AND ALL PROPERTY DURING SUCH STAY, CHARTER BOATS OWNED OR OPERATED BY SINGLE FIN SURF CHARTERS.
